You must be informed when you materially interact with an automated agent, unless that is manifestly obvious or a strict investigative exception applies.
Automated systems
Algorithms, automated rules and technical agents may participate in technical execution, but they do not receive institutional powers of their own or eliminate the responsibility of the competent authorities.
Proposed Constitution · reference text · not promulgatedThe Constitution looks at actual function and effect, not at a technical or commercial label or expressions such as “recommendation” or “decision support”.
Algorithms, automated rules and technical agents may participate in technical execution, but they do not receive institutional powers of their own or eliminate the responsibility of the competent authorities.
A commercial label does not determine the legal regime
A system is high-impact when it determines, materially recommends or is routinely followed in decisions about rights, sanctions, benefits, identity, liberty, property or political participation. Calling the system a recommender does not reduce its impact when, in practice, its output becomes a presumption or makes departing from the conclusion exceptional.
Automation does not displace authorship
Automated agents are not citizens and do not hold voting rights. In public acts, a responsible institutional authority continues to exist. A software error does not prevail over a valid rule: when the system executes a consequence incompatible with applicable law, the person has a right to correction and remedy.
How this right appears in practice
A materially adverse decision cannot hide behind the phrase “the algorithm did it”.
State-generated synthetic content that could be mistaken for an authentic record or communication requires identification or provenance proportionate to the risk.
Implication for people who use Candeia
When a corresponding operation exists in Sistema Candeia, it will be carried out by the competent module. GOV.CANDEIA explains rules, limits and pathways; it does not make the decision or create legal status on its own.
What this safeguard does not mean
Beneficial automation may be used where the law permits it and controls are adequate.
Not all public-sector software is a high-impact system; the regime depends on its function and material effect.
Exploitable technical secrets may remain protected. Even so, the decision must be explainable and contestable.
