A false positive in deduplication cannot by itself decide that you are another person or committing fraud; there must be adjudication by a competent authority and a means of challenge.
Biometrics, authentication and non-exclusion
Biometrics may assist identity and deduplication, but the proposed Constitution prohibits turning it into an absolute requirement for identity, an essential service or the exercise of a right.
Proposed Constitution · reference text · not promulgatedNo person should lose identity or a service because their body does not work as a sensor expects.
Biometrics may assist identity and deduplication, but the proposed Constitution prohibits turning it into an absolute requirement for identity, an essential service or the exercise of a right.
A secure alternative is a requirement of inclusion
A physical, technical or reliability-based inability to provide biometrics must have a secure alternative method, a documented procedure and a remedy. Children cannot depend on successful biometric capture for recognition of legal personality or birth registration.
If any exceptional use is contemplated, the limit is strict
In the digital environment, mass biometric identification is incompatible with the logic of minimisation and non-exclusion. The Constitution also sets a hypothetical limit for any future remote use in physical space: any exception would depend on a serious circumstance, an individually specified person, strict delimitation, a prior judicial order and the absence of a less intrusive alternative; this does not describe any current capability of Candeia.
How this right appears in practice
Biometrics used for authentication do not automatically become an investigation or intelligence database.
Participation in a political, journalistic, trade-union, religious or civic gathering is not a basis for biometric identification.
Implication for people who use Candeia
When a corresponding operation exists in Sistema Candeia, it will be carried out by the competent module. GOV.CANDEIA explains rules, limits and pathways; it does not make the decision or create legal status on its own.
What this safeguard does not mean
Biometrics are not prohibited; they require necessity, purpose, security and an alternative.
Exceptional targeted searching is not equivalent to indiscriminate recognition of the population.
An alternative method must also preserve security and prevention of duplication where legally necessary.
