Autonomy and cognitive liberty

The proposed Constitution protects cognitive liberty, mental integrity and the confidentiality of neural data. Technology cannot turn thought, emotion or behaviour into a surface for coercion by Candeia’s institutions.

Art. 14 Art. 37 Art. 77 Art. 80
In brief

The person remains the original subject of rights even when systems can infer, stimulate or interact with mental states.

The proposed Constitution protects cognitive liberty, mental integrity and the confidentiality of neural data. Technology cannot turn thought, emotion or behaviour into a surface for coercion by Candeia’s institutions.

A constitutional limit on coercive neurotechnology

Candeia’s institutions may not use subliminal manipulation, neural stimulation, brain-computer interfaces or equivalent technology to interrogate, punish, discipline, obtain consent, induce political, religious or ideological preference, or alter behaviour against a person’s will.

Consent must remain free and informed

Neurotechnological intervention on a person depends on free and informed consent for a compatible therapeutic or scientific purpose, except for a strictly necessary medical emergency. Investigation, security or administrative convenience do not create exceptions to the prohibitions on coercion.

What this means for you

How this right appears in practice

01

Intimate inferences and neural data deserve enhanced protection, not treatment as ordinary telemetry.

02

Sistema Candeia may not use persuasive architecture to replace consent with hidden inducement.

03

If a technology affects autonomy or a high-impact decision, challenge rights, risk assessment and institutional accountability continue to apply.

Implication for people who use Candeia

When a corresponding operation exists in Sistema Candeia, it will be carried out by the competent module. GOV.CANDEIA explains rules, limits and pathways; it does not make the decision or create legal status on its own.

Limits and institutional honesty

What this safeguard does not mean

The protection does not prevent consented, lawfully regulated research or therapeutic use.

Autonomy does not mean that every communicative influence is prohibited; the enhanced focus is on coercion, subliminal or neural manipulation, and equivalent intimate data.

A medical emergency has its own regime and does not become a general authorisation for intervention.
