Arts. 14–16 · a person is not an account, digital wallet or credential

Digital identity and Root Identity

The proposed Constitution sharply separates the person from their technical artefacts. An account, digital wallet, avatar, device or credential may represent relationships with Sistema Candeia; none of them replaces legal personality.

Proposed Constitution · reference text · not promulgated
Art. 14 Art. 15 Art. 16 Art. 71 Art. 72 Art. 85
In brief

Root Identity is legal uniqueness for functions that require it — not a universal public identifier or an excuse to centralise all data.

The proposed Constitution sharply separates the person from their technical artefacts. An account, digital wallet, avatar, device or credential may represent relationships with Sistema Candeia; none of them replaces legal personality.

Uniqueness without universal exposure

Root Identity must prevent duplication where uniqueness matters, such as civil and political rights, but it may be implemented with federated, compartmentalised architecture and cryptographic proofs. The Constitution itself states that this does not require a single central database, mandatory biometrics or a single provider.

Technical failure does not erase the person

Compromise of a token, key, credential or identifier does not change who the person is or automatically cancel citizenship, residence, property or rights. The correct response is containment, rotation, reissuance or migration with continuity of legal identity.

What this means for you

How this right appears in practice

01

Losing a credential must not be equivalent to disappearing from the legal system.

02

You must have an alternative path when you do not have usable biometrics, your own device or a standard document.

03

Different acts may require different levels of identity assurance instead of requiring the full Root Identity in every interaction.

Implication for people who use Candeia

When a corresponding operation exists in Sistema Candeia, it will be carried out by the competent module. GOV.CANDEIA explains rules, limits and pathways; it does not make the decision or create legal status on its own.

Limits and institutional honesty

What this safeguard does not mean

Uniqueness does not create multiple votes or statuses through multiple accounts.

Alternative proof does not mean accepting any claim without proportionate verification.

Persistent legal identity does not prevent correction of incorrect or contested attributes.
