You must be able to obtain your own data in a structured format within legal limits.
Portability, interoperability and provider exit
A person must be able to receive their data in an organised format usable by other systems, within legal limits. Important public services must also allow a change of technology or provider without losing records, history, authenticity or rights.
Proposed Constitution · reference text · not promulgatedPortability is not merely “downloading your data”: it prevents provider dependence that makes it impossible to prove, migrate, reconstruct or challenge a public function.

Port with context and provenance
Where necessary, an export must include interpretation metadata, configurations, trails and evidence indispensable to continuity or challenge. Migrating without that context may preserve bytes while destroying legal meaning.
Provider exit is part of informational sovereignty
A critical service may not depend on a single provider to the point that the provider holds confirmed state from the competent source, indispensable evidence or the ability to seek a remedy. Contracts and architecture must permit replacement, recovery and continuity proportionate to risk.
How this right appears in practice
Changing providers cannot erase decision history or prior accountability.
Failure of external technology must have a continuity path for critical functions.
Implication for people who use Candeia
When a corresponding operation exists in Sistema Candeia, it will be carried out by the competent module. GOV.CANDEIA explains rules, limits and pathways; it does not make the decision or create legal status on its own.
What this safeguard does not mean
Portability does not mean erasing retention, evidentiary or archival obligations where legally necessary.
Legitimate third-party secrets may require controlled access without blocking continuity.
Interoperability does not require the State to preserve a particular provider, protocol or technology forever.
