Within that scope, the proposed Constitution requires a strict lawful purpose, independent oversight and judicial controls. Dissent, journalism, religion, trade-union activity, criticism and political participation are not, by themselves, grounds for surveillance.
What counts as intrusion
Interception, sensitive metadata, forensic extraction, spyware, sensor activation, persistent location tracking, digital infiltration, correlation across protected databases and acquisition of sensitive data from commercial or external sources may constitute intrusive measures. The technical label used does not reduce the safeguard.
No general authorisation
Orders must delimit the target, selector, legal ground, purpose, technique, data categories, duration, minimisation, third parties, retention and recipients. Authorisation by topic, political keyword, social group, profession, community or open-ended set of people is prohibited.
The shortest necessary duration, with no automatic renewal.
Reduction of third-party and privileged material.
Judge, independent controls, audit records and verifiable evidence.
What this means for you
How this right appears in practice
Your political, journalistic, trade-union, religious or civic activity must not by itself serve as a selector or source of suspicion.
Untargeted bulk acquisition of private content or sensitive metadata to discover future targets is prohibited.
Extreme urgency may permit a very short, targeted measure, but it must quickly reach judicial review and may not be renewed in a chain to avoid that review.

Limits and institutional honesty
What this safeguard does not mean
A person protected for civic activity does not gain immunity for their own unlawful acts; an investigation must rely on objective facts independent of the protected activity.
Legitimate operational secrecy may limit immediate disclosure without eliminating oversight and accountability.
Defensive cybersecurity does not automatically become an intelligence power.
