ScopePublic information
In summary
The essentials
The Constitution prohibits inventing parentage merely to complete a record. At the same time, it protects the child's right, as far as possible, to know and preserve their name, family relationships and legitimate elements of their identity.
How it works
Family relationship and evidence
EqualityRules may not discriminate on the basis of sex, gender, marital status or documentary status.
→
EvidenceThe register must distinguish established facts from information that remains uncertain.
→
RestorationElements that were unlawfully suppressed must be capable of restoration through an appropriate procedure.
For the person
Practical consequence
The registration module must allow correction, supplementation and challenge without erasing the prior chain. If parentage is disputed, the interface must show the legally accurate status rather than manufacture certainty.
Limits
Safeguards and conditions
Parentage may not be presumed merely to “complete a form”.
The parents' documentary status does not deprive the child of identity.
Rectification must not silently erase the record history.
