Institutional status
Today
No real Government-formation process is under way because the permanent Assembly and Government are not yet established.
When it becomes operational
Once there is an elected and established Assembly, Government formation will follow the nomination, vote and investiture process provided by the constitutional order.
Constitutional formation flow
Automatic opening of the window
An election, resignation, vacancy, loss of confidence or another constitutional event creates the need for a new investiture. The ordinary window lasts 30 days.
Art. 219First nomination within 7 days
The Presidency consults the Assembly leadership, parties and parliamentary groups and nominates a person with a genuine prospect of obtaining confidence.
Art. 216First vote
The candidate presents a programme and needs an absolute majority of the legal membership. The vote must occur within the applicable constitutional deadline.
Art. 217Second vote after 48 hours
If an absolute majority is not reached, the second vote allows a majority of valid votes, provided an absolute majority of the Assembly’s legal membership participates.
Art. 218Successive candidacies
If the second vote fails, initiative shifts to the parliamentary sphere and new candidacies may be processed while time remains in the window.
Arts. 216–219Limited dissolutions
If the window closes without investiture, linked dissolution may occur only within constitutional limits. The same cycle allows at most two dissolutions for inability to form a Government.
Art. 219Parliamentary deadlock-breaking mechanism
After the second dissolution and a final ordinary window without a result, the deadlock-breaking mechanism led by the Assembly opens, without presidential nomination, choice or veto.
Art. 219, §§ 5–12Bound appointment
Once investiture is certified, the Presidency appoints the Prime Minister within 24 hours. Presidential omission creates no veto: the authentic certificate of the Assembly’s Bureau perfects the appointment by operation of law.
Art. 220Key deadlines at a glance
What the formation system prevents
- the President may not freely choose a minority Government outside the rules;
- the Constitutional Court may ensure deadlines and integrity, but may not choose a candidate, programme or coalition;
- absence or abstention does not become presumed support;
- formation-related dissolutions may not repeat indefinitely;
- deliberately caused technical failure or artificial delay does not restart the cycle.
How this appears today in Candeia OS
Government formation in Candeia OS
The Assembly, Presidency and Government areas already appear in the interface, but the investiture procedure, its deadlines, certifications and deadlock-breaking mechanisms are not yet operational.
Primary basis: Arts. 216–220, with dissolution limits in Arts. 202–204.
