Institutional status
Current state
The constitutional structure below is a proposal that has not yet been promulgated. There is no President, Prime Minister, ministers or permanent constitutional Government invested under these rules.
When these institutions are formally established
Competences only begin to produce internal institutional authority after the constituent, electoral, parliamentary and investiture acts required by the legal order then in force.
One Republic, two heads
Presidency
Represents constitutional continuity, promulgates laws, makes the appointments expressly assigned to it and exercises strictly enumerated guarantee functions.
Prime Minister and Government
Direct the Administration, implement policies and regulations within the law and are politically accountable to the Assembly.
Assembly and checks
The Assembly invests and oversees the Government. Justice, the Court of Audit, the Central Bank and the other independent institutions retain their own competences.
Who decides what?
| Matter | Presidency | Assembly | Government | Oversight |
|---|---|---|---|---|
| Formation of the Government | Makes the first nomination and formalises the appointment already determined by the parliamentary process. | Invests the Prime Minister and maintains or withdraws confidence under the constitutional rules. | Begins to exercise political direction after valid investiture and assumption of office. | The Constitutional Court may ensure deadlines and integrity without choosing a candidate or coalition. |
| Laws | Promulgates, may return a bill once or request preventive review within constitutional limits. | Deliberates, approves and may confirm a returned bill. | Implements the law and may regulate it within statutory authorisation. | Judicial and constitutional review remains independent. |
| Administration | Does not direct ministries, the budget, monetary policy or the national technical administration. | Legislates, authorises and oversees within its competence. | Directs the Administration and coordinates ministries. | Oversight bodies and independent institutions do not receive political instructions in protected decisions. |
How authority reaches the Government
The existence of public pages, installable modules or administrative screens does not create an office, mandate, assumption of office or competence. Authority depends on the corresponding legal process.
