Institutional status
Current status
The constitutional structure below is a proposal that has not yet been promulgated. There is no President, Prime Minister, ministers or permanent constitutional Government invested under these rules.
When these institutions are formally established
Powers only begin to produce internal institutional authority after the constituent, electoral, parliamentary and investiture acts required by the order then in force.
Presidential powers
Promulgation and review
Promulgates laws and may, once and within the deadline, return a bill with public reasons or refer it for preventive review by the Constitutional Court.
Bound acts
Takes part in the first nomination of a candidate and formalises the appointment of the Prime Minister already invested by the Assembly; ministers follow the Prime Minister’s binding proposal.
Representation and safeguard
Institutionally represents the Republic, makes appointments expressly provided for, accredits representatives where legally appropriate, grants honours and exercises enumerated safeguard functions.
Limits that protect separation of powers
May, when authorised by the Constitution
- promulgate;
- return a bill once;
- trigger preventive review once;
- make constitutional appointments within applicable lists and deadlines;
- formalise the Prime Minister’s parliamentary investiture.
Does not direct or replace
- ministries and day-to-day Administration;
- the budget and monetary policy;
- the parliamentary choice of the Government;
- Justice or independent institutions;
- powers beyond those provided by the internal order merely by use of the title.
Deadlines that prevent blockage
Presidential accountability
The proposal requires qualified grounds for removal from office. Impeachment requires two thirds of the Assembly and adjudication by the Constitutional Court, with adversarial proceedings, defence rights and its own evidentiary standard. Political disagreement, an unpopular decision or a good-faith error are not sufficient by themselves.
What can already be explored
Presidency in the Sistema Candeia
The Presidency already has a demonstration interface in Candeia OS, but constitutional procedures are not yet carried out as official acts.
Primary basis: Arts. 205–214 and, for Government formation, Arts. 216–220.
