You may seek urgent relief before an irreversible violation is completed.
Constitutional remedies and redress
A right without a way to stop a violation would be only a declaration. In Candeia, these remedies concern first of all identity, access, digital property, data and internal decisions. The proposed Constitution also provides for urgent relief, habeas corpus, collective responses, redress and structural remedies. In the physical world, measures concerning custody belong to the competent real-world authorities; Candeia does not exercise physical custody.
Proposed Constitution · reference text · not promulgatedA right is not an abstract promise: it constrains concrete decisions.
The architecture is deliberately adapted to digital failures: an essential identity lockout, abusive freezing of property, serious privacy harm, de facto digital exile or a technical incident common to thousands of people may justify immediate relief and even systemic correction at the source of the problem.
Urgent relief need not wait for the harm to be complete
Art. 46 allows immediate measures against unlawful deprivation of liberty and other serious violations. Where the source is common — an automated rule, database or registry failure — the response may reach the affected group without requiring thousands of identical actions.
Correcting the system without governing through the court
Structural remedies may specify the legally required outcome, deadlines, proof of compliance and safeguards. But they do not authorise a court to create public policy, a tax, a crime, a benefit or a competence that does not exist where the Constitution reserved those choices to another branch.
Redress can be collective and automatic
Systemic harm may be remedied through automatic restoration of status, reprocessing, standardised restitution, correction of records or notification of affected people. This reduces the injustice of forcing each person to discover and litigate the same error separately.
Practical consequences
A recognised systemic error should be corrected at its source whenever possible, not only case by case.
A petition, reasons, a reasonable time and an appeal form part of the right to an effective public response.
What this safeguard does not authorise
A structural remedy does not authorise the Judiciary to permanently assume the political or technical functions of other bodies.
Collective relief does not eliminate an individual's right in respect of their own harm that was not remedied by the common mechanism.
Seek relief through Candeia OS
When Candeia's Judiciary is operational, applications and appeals will be initiated through Candeia OS; processing and decisions will take place in the competent Sistema Candeia module. GOV does not simulate filing or judicial decisions.
