How Candeia is organised: Constitution, rights and internal institutions

The constitutional proposal describes an internal order in which power belongs to citizens and is limited by rights, laws and institutions. Today, this Constitution remains an unpromulgated proposal: GOV.CANDEIA explains how this organisation was designed and the actual stage of each part of the system.

In summary

Three truths for understanding Candeia

01

What exists now

There is an institutional project in formation, a Proposed Constitution used as the project's reference text, a public portal and digital infrastructure under development. The Constitution has not yet been promulgated.

02

What the Constitution establishes

If and when it enters into force through the prescribed procedures, the order places citizens and the Constitution above the Founder, code, capital, operators, creditors and infrastructure.

03

What remains outside the system

A domain, server, map, document or internal contract may organise Candeia, but its effects toward third parties depend on the legislation, providers and relationships actually applicable.

Title I · Foundations

The constitutional order is designed around limits on power

The opening articles do not begin with technology. They begin with the person, the citizen, the Constitution and the responsibility of those exercising public functions.

Open Art. 1 in the reader
Human dignity

The person is a foundation of the order and cannot be reduced to an account, credential, asset or system resource.

Popular sovereignty

All public power emanates from citizens. Wealth, property, control of code or economic contribution confer no additional vote or political power.

Freedom and legal equality

The constitutional architecture requires rights, due process and equality before the legal order, including in relation to automated systems.

Accountability and pluralism

Public authority is not personal power: it must have a legal basis, publicity, oversight, opposition and the possibility of review.

Institutional continuity

Candeia's essential functions must not depend on the unilateral will of the Founder, a provider, creditor, domain or platform.

Constitutional supremacy

No authority, majority, Founder, technical operator, economic organisation or contract stands above the Constitution.

Popular sovereignty

Owning the server does not mean holding authority

The Constitution deliberately separates political power, property, infrastructure and technical authority. This separation is structural: owning code, keys, a company, intellectual property or assets does not confer political power over people.

1

Citizens are the source of public power.

2

The Constitution defines powers and limits.

3

Competent institutions make decisions within their mandates.

4

Technology implements the function; it does not create the legal power.

Constitutional supremacy

Code, contracts and administrative orders cannot rewrite the Constitution

Candeian legality is designed as a chain of authority. Incompatible software does not silently alter rights; a private agreement does not create public power; and a general rule should not produce effects before authentic publication.

01Constitution and norms of constitutional rankHighest level, subject to the unamendable clauses.
02Norms and instruments with constitutionally recognised rankOnly to the extent and through the procedure authorised by the Constitution.
03Organic laws and ordinary lawsEach category operates within its own subject matter and quorum requirements.
04Regulations, administrative acts and technical executionSubordinate to higher norms; code implements the law, it does not replace it.
Art. 4 · Supremacy and invalidity Art. 5 · Legality and publicity Art. 6 · Hierarchy of norms Art. 7 · Technological neutrality
Separation of functions

Technical integration does not mean concentration of power

Legislation, execution, jurisdiction, independent oversight and technical architecture may interoperate while preserving their own powers.

CitizensPopular sovereignty
ConstitutionPowers + rights + limits
LegislativeCreates norms within the Constitution
ExecutiveAdministers and executes the law
JudicialDecides disputes and reviews legality
Independent bodiesOversee and safeguard integrity and continuity
TechnicalOperates the architecture without replacing legal decision-making
GOV ↔ Sistema Candeia ↔ institutions

The interface displays. The infrastructure executes. The competent institution decides.

01

GOV.CANDEIA

It is the public gateway for presentation, discovery, documentation and access. It may display status, publish content, explain procedures and direct users to modules.

  • It does not replace the competent source merely because it displays data.
  • It does not create a vote, judgment, registry entry or balance.
  • It may be replaced or become unavailable without extinguishing rights, records or internal decisions.
03

Competent institutions and records

They are the legal sources of authority within each subject matter: the body, registry or official chain of records recognised by the Constitution and the law.

  • In the event of a discrepancy, the competent source prevails.
  • The state of relevant records must be versioned and auditable.
  • An external provider never gains public authority merely through integration.

Art. 8 · Institutional truth

Candeia must state exactly what it is — including its own limits

The Constitution makes institutional honesty a duty: communications must distinguish internal validity, technical interoperability and any effect that depends on third parties outside the system.

It may state

  • that an institutional project and a proposed constitutional order exist;
  • that digital territory exists as an internal category of the project;
  • that a particular counterparty accepted something, when there is real evidence and the scope is stated correctly;
  • that internal designs, systems and documents exist when they actually do.

When discussing external effects

  • each integration must identify the counterparty and the scope that actually exists;
  • digital representations do not by themselves create effects over physical spaces;
  • external identifiers may be used only when actually assigned;
  • internal documents produce effects outside Candeia only when there is an applicable legal basis and acceptance.
Sovereign continuity

The Republic cannot be contained within a single domain, provider or key

Continuity, in this architecture, means keeping the legal order and essential functions recoverable without turning contingency into an excuse to suspend democracy or rights.

GOV failure

Does not erase rights and records

An outage, domain hijacking, incorrect cache or portal defacement does not by itself alter rules, votes, decisions, records, balances or internal acts.

Provider failure

Cannot become a veto power

Constitutional continuity cannot depend on the unilateral will of a company, creditor, technical operator or service provider.

Technical migration

The function must survive the implementation

Sistema Candeia, records and digital territory are designed to survive reimplementation, migration, reconstruction and replacement of technology.

Emergency

Continuity does not suspend rights

Preserving operation does not authorise eliminating democracy, due process, judicial independence or non-derogable rights.

Art. 10 · Sovereign continuityArt. 150 · Digital territoryOperational status
Essential sovereign assets

Protection of the function, not general asset shielding

The Constitution identifies assets whose loss could compromise sovereign functions and permits others to be designated by law only under objective criteria of indispensability.

What this means for you

Four practical situations

01

The portal displays incorrect data

A display error does not automatically create a right or obligation that does not exist. The competent official source prevails, but good-faith legitimate reliance must be protected within constitutional limits.

02

A provider goes offline

Essential rights must not depend exclusively on GOV or a single provider. Alternative channels and contingency mechanisms proportionate to the risk must exist.

03

A company owns essential technology

Private property may exist and be remunerated, but it does not turn the owner into a legislative, electoral, judicial, monetary or registry authority.

04

You see a map of Candeia

A map, district, address or digital environment is a representation of digital territory. It does not prove physical territory, an international border or spatial jurisdiction toward third parties.

Now and later

The designed constitutional order is not presented as already being in force

Now

Project in formation

the reference constitutional text is preserved as the project's legal basis; GOV and Sistema Candeia may technically exist to the actual extent of their current basis. Publishing this portal alone does not promulgate the Constitution.

Constituent process

Prescribed stages and certifications

The constitutional proposal governs conditions, votes, audits, certifications and Foundation requirements. The portal must mark a stage as complete only when the corresponding event and real evidence exist.

Foundation Day

Entry into force depends on real requirements

The Constitution provides that initial entry into force depends on the constituent process, Foundation requirements, independent certification and authenticated public promulgation.

Later

Institutions exercise their own powers

Once the order is validly activated, each branch, independent body and responsible module operates within its constitutional powers — without turning Sistema Candeia into a super-agency.

Constitutional basis
