Candeia’s Justice system is provided for in the Constitutional Proposal and has not yet been established. This page explains the architecture and guarantees without presenting courts, judges or proceedings as already existing.
Once active, a person may use the Justice system to challenge an internal administrative decision, dispute a contract, digital property, a consumer relationship or another Candeia right. Filing will begin through Candeia OS; processing, decision and registration will occur in the competent module of Sistema Candeia.
How Justice is organised
What prevents capture of the Justice system
No judge receives instructions on the outcome of a case from the Government, Assembly, party, Founder, supplier or administrative authority.
Jurisdiction, assignment and substitution follow general rules established before the case; there is no adjudicator chosen ad hoc.
Defence, adversarial proceedings, evidence, publicity as the rule, reasoned decisions and an effective appeal.
Technical failure cannot eliminate urgent protection; alternative channels and contingency arrangements must exist.
The Judiciary, prosecution and defence are not the same thing
The Judiciary decides internal disputes. The Public Prosecutor’s Office defends legality and acts in accountability proceedings that may validly exist within Candeia. The Public Defender’s Office provides legal assistance and representation to people who lack sufficient resources or face a material barrier to access. Real-world crimes and criminal prosecution remain under the competent authorities of each country.
GOV informs. Real proceedings do not happen here.
Viewing a GOV page does not file a petition, create a case, produce a decision or start an investigation. When the Justice module is available, real proceedings will be initiated through Candeia OS in the competent module of Sistema Candeia.
