Candeia’s Justice system is provided for in the Constitutional Proposal and has not yet been established. This page explains the architecture and safeguards without presenting courts, judges or proceedings as already existing.
A proceeding may concern, for example, an internal contract, digital property, a consumer relationship, an administrative decision, a Candeian election or another right within the ecosystem. The procedure must allow defence, evidence, a reasoned decision and an appeal.
How to think about a proceeding
Publicity with proportionate protection
Hearings and trials are public as a rule, but a child, victim, privacy, professional secrecy, an investigation or security may justify proportionate restrictions. Case law may be pseudonymised to avoid unnecessary exposure without concealing the judicial reasoning.
Digital Justice is not “less Justice”
Petitions, notices, powers of attorney, evidence and decisions may exist exclusively in electronic form where authenticity, adversarial process, accessibility and preservation are ensured. If the digital channel fails or excludes someone, an appropriate alternative must exist.
Electronic evidence and automation
Evidence may not be rejected merely because it is digital; its weight depends on authenticity, integrity, authorship, provenance and the ability to challenge it. No person may suffer a serious internal sanction or lose a fundamental right within Candeia through a decision substantially determined by automation without effective assessment by a competent authority. Real-world criminal matters remain under the jurisdiction of the competent real-world authorities.
