Candeia’s Justice system is provided for in the Constitutional Proposal and has not yet been established. This page explains the architecture and safeguards without presenting courts, judges or proceedings as already existing.
If someone challenges an access suspension, an administrative decision or a right over a digital asset, the natural-judge rule prevents choosing the judge after the dispute is already known.
The safeguard in plain language
Once a dispute arises, no one may create or choose the “right” court to obtain a desired outcome. Platform moderation, a technical team or an authority subordinate to an interested party also cannot substitute for Justice.
Assignment and substitution matter as much as the court’s name
The prior existence of the court is only one requirement. Case assignment and the substitution of judges must follow objective criteria. Disqualifications must be reasoned and cannot be manufactured to alter a panel or quorum.
Institutional independence
The Government, Assembly, a party, the Founder, a provider and the National Council of Justice cannot direct the substance of a decision. A higher court may intervene only through appeals and legally defined jurisdiction.
What this means for you
The rule protects both those who face the State and those who litigate against another person. Neutrality begins before the decision: in jurisdiction, assignment, substitution, access to evidence and the possibility of appeal.
