Candeia’s Justice system is provided for in the Constitutional Proposal and has not yet been established. This page explains the architecture and safeguards without presenting courts, judges or proceedings as already existing.
A dispute over an internal contract, digital property, a consumer relationship or an administrative decision may be reviewed by the prescribed instances without turning appeal into political command over the judge.
A judicial route, not a chain of command
Specialisation may exist
Specialised chambers or courts may be created by reinforced organic law when they follow general criteria and preserve independence, impartiality, defence rights and appeal. What cannot exist is a court assembled for a specific case.
Appeal corrects; discipline does not punish interpretation
Legal error or good-faith interpretation is corrected through appeals and judicial mechanisms. It must not become disciplinary punishment or political removal of the judge.
Details that still depend on legislation
The constitutional proposal does not set out here a complete catalogue of subject-matter jurisdiction by court or chamber, classes of appeal, fees or ordinary time limits. Those details must come from the reinforced organic law and actual procedural legislation.
