The Assembly has not yet been established.
This page explains which internal matters require a more protected legislative process.
Two levels of protection
| Category | Final quorum | Use |
|---|---|---|
| Common organic law | Absolute majority of the total legal number of seats | Structurally reserved matters that do not fall within the reinforced core. |
| Reinforced organic law | Three fifths of the total legal number of seats | Citizenship, the electoral system, Justice, independent institutions, root identity, the Central Bank, emergencies, surveillance, funds and other expressly reinforced structures. |
Classification is material
A mixed bill may require separate votes on reinforced provisions. If the reinforced matter is inseparable, the entire bill depends on a three-fifths majority. A temporary rule, budget measure, reorganisation or delegation may not indirectly produce an effect that would require a higher quorum.
Mandatory preventive review
After final passage, every organic law is referred by the Bureau to the Constitutional Court before promulgation for mandatory preventive review. The Court reviews material classification, quorum, procedure and constitutional compatibility. Incorrect classification prevents promulgation until correction and renewed passage.
Urgency does not lower the quorum
A state of emergency, political agreement, rules of procedure, vacancy or urgency does not turn a reinforced law into a common law. Insufficient votes leave the previous compatible regime in place until valid replacement.
Primary basis: Art. 192.
