The Assembly has not yet been established.
This page protects participation and oversight by the opposition and minorities within the Assembly.
Positive rights, not merely the absence of censorship
Minorities and the opposition have proportional and effective access to committees, oversight, information, debate time, rapporteurships and control instruments. Where an opposition exists, at least one relevant permanent oversight body will have its chair or principal rapporteurship held by an opposition representative under an objective rule.
The same oversight function requires equivalent information
The majority and opposition receive equivalent content when performing the same oversight function. Secrecy and accreditation may not be used for partisan purposes to exclude opposition parliamentarians generically.
The majority cannot change the rules after the election
Minority rights to oversight, participation and information may not be redesigned ad hoc after the electoral result is known merely to neutralise the political composition produced by the citizens.
Protected access still carries duties
A parliamentarian who receives classified information remains subject to the applicable confidentiality duties, while retaining protected channels to report illegality to the Constitutional Court, Court of Audit, Ombudsman, Public Prosecution Service or other competent authority.
Primary basis: Art. 190.
