Historical role without personality cult · proposed internal function

Founding Architect

The proposed Constitution recognises a historical origin while placing very strong limits around any future constitutional office. The aim is to preserve rare technical competence without turning creation, ownership, family ties or control of infrastructure into political sovereignty.

Historical roleRecognises the origin of the project without creating personal sovereignty.
Future officePersonal, technical, exceptional and non-repeatable.
Succession ruleProperty may be transmitted; public power may not.

Why this design exists

A digital constitutional infrastructure may, during its creation phase, depend on highly concentrated knowledge. The proposed Constitution does not ignore that fact. Instead, it frames the issue as a legal problem of competence, audit and succession: it recognises delimited technical authority, requires institutional documentation and recovery, and defines from the outset who takes over when the personal exception ends.

Historical recognition of the creator does not mean ownership of citizens, popular sovereignty, elections, judicial decisions, currency, the Civil Registry or public assets.

The complete map

Each topic below has its own page because technical authority, remuneration, intellectual property and succession are legally distinct. Mixing them would create exactly the conflict that the Constitution seeks to avoid.

01

Technical office

The constitutional office is personal, exceptional and non-repeatable; it is neither a parallel Presidency nor a hereditary title.

Open page →
02

Technical authority

Architecture, security, recovery and technical target state within legal parameters defined by other authorities.

Open page →
03

Limits

No power to decide judgments, elections, currency, citizenship, civil registry or public policy.

Open page →
04

Audit

Tamper-resistant audit logs, access recertification, independent review and proportionate transparency.

Open page →
05

Continuity

Credential recovery, Continuity Objection, interim arrangements and succession without a personal single point of failure.

Open page →
06

Continuity Council

Independent collegiate body that prepares succession and assumes final technical authority after definitive cessation of the personal office.

Open page →
07

Functional remuneration

Future functional remuneration for exercising the office, independently set and separate from royalties, licences and other economic rights.

Open page →
08

Office × property

Public competence and private property coexist behind barriers of conflict of interest, recusal and independent economic decision-making.

Open page →
09

Founding IP

Only assets and rights with a real chain of title may form part of the Founding Intellectual Property.

Open page →
10

Patrimonial succession

Economic rights may be transmitted within the limits of applicable law; defects and limitations follow the succession as well.

11

Public power is not an inheritance

Family, a holding company, an heir, provider or beneficiary does not succeed to the office or receive public power.

Four planes that must not be confused

History

Recognition of the person who originated the project and of assets of founding origin, without turning history into a title of sovereignty.

Public-technical

Possible constitutional exercise of the national architecture function, subject to rights, rules, controls, audit and succession.

Private-proprietary

IP, shareholdings and economic rights only to the extent that they validly exist under applicable law.

Permanent institutional

Continuity must outlive the person: after definitive cessation, public technical authority passes to the National Council for Technological Continuity.

From the person to the institution

1 · Creation

Historical origin and technical construction of the project.

2 · Ratification

The future office arises only if the specific constituent process activates it.

3 · Controlled exercise

Technical authority with segregation, audit logs, auditing and limits of competence.

4 · Succession

Once the office ceases, the public competences pass automatically to the Council — never to heirs.

What this area deliberately does not do

It does not create a promotional biography, attribute infallibility, present private property as state property, turn intellectual property into a right to govern, treat descent as political succession or hide the audit, incapacity or removal mechanisms provided for in the proposed Constitution.
